The Commercial Court is considering initiating a pilot scheme to sequence delivery of witness statements (and supporting documents) before discovery, modelling a New South Wales Practice Direction. The CLAI proposes to hold this seminar to consider the procedure in New South Wales and other possible alternative approaches to discovery.
